These Terms of Use ("Terms") govern your use of the Sayelle mobile application ("the App"). By downloading or using the App, you agree to these Terms.

1. Who we are

Sayelle is operated by DAVID HRDALO / ABN: 56942727929, based in Brisbane, QLD, Australia. You can contact us at support@sayelle.app or via the Support page.

2. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use, subject to these Terms and Apple's standard end-user licence terms.

3. Ownership

The App, its software, design, branding, character names, illustrations, and all related content are owned by us or our licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers any ownership to you.

4. AI-generated responses

Sayelle uses an on-device AI language model to generate conversation partners' replies and feedback. AI-generated content may occasionally be inaccurate, unnatural, or incorrect, including for grammar corrections. Use your own judgment and don't rely on the App as an authoritative source of language instruction.

5. Educational purpose, no guaranteed outcome

Sayelle is educational software intended to help you practice conversational Spanish. We don't guarantee any particular level of fluency, learning outcome, or proficiency result from using the App.

6. Availability, updates, and device compatibility

The App requires a compatible iOS device and enough free storage to download the on-device language model over Wi-Fi. We may release updates, and features, scenarios, or lessons may change, be added, or be removed over time. We don't guarantee uninterrupted or error-free availability.

7. Purchases, subscriptions, and refunds

Any purchases are billed through Apple's App Store and governed by Apple's own terms and payment methods. To request a refund, use Apple's standard refund request process. Nothing in these Terms limits any consumer guarantee or refund right you have under the Australian Consumer Law or other applicable law, regardless of Apple's or our own refund policies — see Section 9 below.

8. Acceptable use

You agree not to: reverse-engineer, decompile, or extract the App's underlying models or code; use the App to generate unlawful, abusive, or harmful content; attempt to disrupt or overload the App; or use the App in any way that infringes on our intellectual property or that of others.

9. Liability and your consumer rights

To the maximum extent permitted by law, the App is provided "as is" and we exclude all warranties not expressly stated in these Terms. However, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law (including guarantees of acceptable quality and fitness for purpose) or any equivalent consumer protection law in your jurisdiction. Where permitted, our liability is limited to re-supplying the App or, at our option, refunding the amount you paid for it.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected here with an updated date before they take effect.
